By accessing or using the website at kimallc.com (the "Site") and purchasing products from Excavatorinc, operated by KIMA LLC ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Site or place an order.

We reserve the right to update or modify these Terms at any time without prior notice. Changes take effect immediately upon posting. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

These Terms apply to all visitors, customers, and users of the Site. By placing an order, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract.

All prices are listed in US Dollars (USD) and are subject to change without notice. The price applicable to your order is the price displayed at the time you complete your purchase. We reserve the right to correct pricing errors and cancel orders placed at incorrect prices.

When you place an order, you are making an offer to purchase. Your order is not confirmed until you receive an order confirmation email from us. We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent, contain errors, or cannot be fulfilled due to inventory or shipping constraints.

Orders may be cancelled without charge within 24 hours of placement. After 24 hours, if the machine has entered processing or has been loaded for shipment, a cancellation fee may apply to cover preparation and freight booking costs. Contact us immediately at support@kima.com if you wish to cancel.

Sales tax is calculated based on your delivery address and applicable state tax laws. The tax amount will be shown at checkout before you confirm your purchase.

We offer free freight shipping to all contiguous 48 US states. Orders to Alaska, Hawaii, or international destinations require a custom shipping quote and are not eligible for free shipping. Delivery timelines are estimates only and are not guaranteed. We are not liable for delays caused by the freight carrier, weather, acts of God, or other events beyond our control.

Delivery is curbside. The freight carrier will place the machine at an accessible point on your property. You are solely responsible for unloading the machine. We strongly recommend having appropriate equipment (forklift, tractor, or skid steer) available at the time of delivery.

Title and risk of loss transfer to you upon delivery. It is your responsibility to inspect the machine upon arrival and note any visible damage on the Bill of Lading before the driver departs. Failure to do so may affect your ability to file a freight damage claim.

If you are unavailable to receive your delivery after the carrier has scheduled an appointment, re-delivery fees charged by the carrier will be passed on to you.

You may request a return within 30 days of the delivery date. To initiate a return, contact us at support@kima.com with your order number and reason for return. All returns require prior authorization and a Return Merchandise Authorization (RMA) number issued by our team.

Eligible returns must be in original or minimally used condition with all included attachments and accessories. Machines that have been significantly used, damaged through misuse, modified, or are missing components may be subject to a restocking or deduction fee, or may be ineligible for return.

We cover the cost of return freight pickup for approved returns. Once the machine is received and inspected at our facility, refunds are issued to your original payment method within 5–7 business days. We reserve the right to deduct the cost of any missing accessories or repair costs for damage caused during the customer's possession.

Returns requested after 30 days of delivery, or for items excluded under our Return Policy, will not be accepted. Custom or special-order machines are non-returnable.

All machines sold by Excavatorinc come with a 1-year limited warranty covering manufacturing defects in parts and workmanship from the date of delivery. This warranty is non-transferable and applies only to the original purchaser.

The warranty does not cover: (a) normal wear and tear items including filters, belts, rubber tracks, and fluids; (b) damage resulting from misuse, neglect, improper maintenance, or accidents; (c) unauthorized modifications or repairs; (d) cosmetic damage that does not affect the machine's operation; (e) damage caused by operating the machine outside its rated capacity or specifications.

To make a warranty claim, contact us at support@kima.com with your order number, a description of the defect, and supporting photos or video. We will evaluate the claim and, if approved, provide replacement parts or repair at no cost to you.

This limited warranty is the sole warranty provided by KIMA LLC and supersedes any other express or implied warranties. We make no warranty that machines will be free from all defects or suitable for any particular purpose beyond what is described in the product listing.

To the fullest extent permitted by applicable law, KIMA LLC and its officers, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, or property damage arising from your use of our products or Site, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your purchase shall not exceed the total amount paid by you for the product giving rise to the claim.

You agree to operate all equipment in accordance with the manufacturer's operating manual and all applicable local, state, and federal laws and regulations. KIMA LLC is not responsible for injuries, damage, or legal consequences resulting from improper use, failure to follow safety guidelines, or operation by unlicensed or untrained individuals.

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such cases, our liability will be limited to the maximum extent permitted by law.

When you place an order or contact us, we collect personal information including your name, email address, phone number, and shipping address. This information is used solely to process your order, communicate with you about your purchase, and provide customer support.

We do not sell, rent, or share your personal information with third parties for marketing purposes. Information may be shared with freight carriers and payment processors as necessary to fulfill your order.
